Resumen de La tutela delle detenute prima e dopo l’ultima riforma penitenziaria

Lo studio esplora i bisogni e i diritti riconosciuti alle donne detenute nella legislazione precedente e successiva alla recente riforma penitenziaria (d.lgs. n. 123 del 2018).
L’attenzione, ancora una volta, sembra concentrata sul ruolo della detenuta madre, più che sulla donna in quanto tale, ignorando l’ampia sfera di interessi e bisogni specifici che caratterizzano l’universo femminile anche nel microcosmo carcerario. A dispetto delle indicazioni provenienti dai trattati internazionali e dagli Stati generali sull’esecuzione penale, il legislatore ha poco più che ritoccato il settore femminile, perdendo l’opportunità di rimediare agli errori del passato (ridimensionati solo dai continui interventi della Corte Costituzionale). Tra le principali carenze, non risulta, neppure, vivificato l’apparato di garanzie teso ad eliminare il fenomeno aberrante dei bambini in carcere mediante un più ampio ricorso alle misure alternative alla detenzione.

The present study explores the needs and rights granted to women held in the previous and subsequent legislation after the recent penitentiary reform (d.lgs. n. 123 of 2018).
The attention, once again, seems to be focused on the role of the mother prisoner, rather than on the woman as such, ignoring the wide sphere of interests and specific needs that characterize the female universe even in the prison microcosm. In spite of the indications coming from international treaties and from the States General on the penal execution, the legislator just retouched the female sector, losing the opportunity to remedy the mistakes of the past legislation (reduced only by the continuous interventions of the Constitutional Court). Among the main shortcomings, the apparatus of guarantees aimed at eliminating the aberrant phenomenon of children in prison is not even revived through a wider recourse to alternative measures to detention
