El derecho real de superficie y la vigencia del Derecho Romano en el nuevo Código Civil y Comercial

    El contenido económico que conlleva el derecho real de superficie, y que favorece la construcción, forestación y/o plantación, imponía su consideración en el derecho argentino, máxime cuando no se encontraba contemplado en el código de Vélez Sarsfield. Lo interesante de la decisión adoptada por los legisladores es la evaluación de la necesidad de incorporar a la normativa vigente el derecho real de superficie siguiendo los antecedentes de la reforma, y respetando el origen de la institución en el derecho romano. Ello implica el reconocimiento de la vigencia de este último en la normativa actual.

    The economic content that involves the real surface rights, favoring the construction, forestry or plantation, imposed its consideration in Argentine law, especially when he was not contemplated in the code of Velez Sarsfield.

    The interesting thing about the decision taken by the legislators is the assessment of the need to join the real surface rights legislation following the history of reform and respecting the origin of the institution in the Roman law involving the recognition of the validity of the latter in the current regulations.
