  El propósito de este trabajo de investigación es el análisis de la Sentencia del Tribunal de Justicia de la Unión Europea de fecha 22 de enero de 2020 —asunto C-177/18— que resuelve una petición de decision prejudicial planteada por el Juzgado de lo Contencioso-Administrativo número 14 de Madrid y que tiene por objeto la interpretación de los artículos 151 y 153 del Tratado de Funcionamiento de la Unión Europea, de los arts. 20 y 21 de la Carta de los Derechos Fundamentales de la Unión Europea y de las cláusulas 4 y 5 del Acuerdo Marco sobre el trabajo de duración determinada, que figura en el anexo de la Directiva 1999/70/CE del Consejo, de 28 de junio de 1999, relativa al Acuerdo Marco de la CES, la UNICE y el CEEP sobre el trabajo de duración determinada. Lo anterior, en un caso entre una funcionaria interina y una Administración Pública respecto a la indemnización por finalización de la relación de servicio.

Who have right to a compensation for termination of the relationship in the light of the CJEU?The aim of this research work is to analyse the Judgement of The Court of Justice of the European Union of 22 January 2020 —Case C-177/18— that resolves a request for a preliminary ruling from the Administrative Court number 14 of Madrid and that concerns the interpretation of Articles 151 and 153 of the Treaty on the Fonctioning of the European Union, of Articles 20 and 21 of the Charter of Fundamental Rights of the European Union and of clauses 4 and 5 of the framework agreement on fixed-term work, which is annexed to Council Directive 1999/70/EC of 28 June 1999 concerning the framework agreement on fixed-term work concluded by ETUC, UNICE and CEEP.
