Hoy en día los adultos mayores tienen una importancia especial, ya que son un reflejo de un fenómeno global: el envejecimiento poblacional, se trata de un grupo vulnerable que demanda una protección especial por parte del Estado, no solamente de sus Derechos Humanos, sino una protección jurisdiccional cuando ellos son parte en un proceso ante el Poder Judicial.
A nivel internacional, esta protección se encuentra dispuesta en las Reglas de Brasilia y en la Convención Interamericana sobre la Protección de los Derechos Humanos de las Personas Mayores, sin embargo, en México la primera no es acatada por el Poder Judicial, al no tener las características de un tratado internacional y la segunda no ha sido suscrita por el Estado mexicano.

Nowadays, older adults have a special importance, since they are a reflection of a global phenomenon: population aging, it is a vulnerable group that demands special protection from the State, not only from their Human Rights, but also from a jurisdictional protection when they are part of a process before the judiciary.
At the international level, this protection is provided in the Brasilia Rules and in the Inter-American Convention on the Protection of the Human Rights of the Elderly, however, in México the former is not accepted by the judiciary, as it does not have the characteristics of an international treaty and the second has not been subscribed by the Mexican state.
