    El derecho al olvido permite a los interesados obtener el borrado y cifrado online de sus datos personales cuando éstos resulten perjudiciales para sus derechos fundamentales y, aunque se configura como una suerte de regla general, el derecho al olvido está sujeto a restricciones e intromisiones. Éstas se contemplan expresamente en las normas reguladoras y se derivan también de la jurisprudencia existente, especialmente por lo que respecta a la colisión con otros derechos fundamentales. Así, la doctrina constitucional en torno a las limitaciones del derecho a la libertad de expresión e información ha quedado obsoleta por la nueva coyuntura digital, principalmente debido a la invalidación de la cláusula exceptio veritatis como elemento de ponderación y a la incorporación del factor tiempo en dicho examen

    The right to be forgotten allow to interested individuals to obtain the erasure and online encryption of their personal data when it can be harmful to their fundamental rights. Although it is configured as a kind of general rule, the right to be forgotten is subjected to restrictions and interference. These limits are expressly provided by regulatory laws and are also derived from the existing jurisprudence, especially as regards the collision with other fundamental rights. Thus, the constitutional case law about the limitations of the right to freedom of expression and information has become obsolete by the new digital situation, mainly due to the invalidation of the exceptio veritatis clause as an element of weighting and the incorporation of the time factor in that examination.
