Resumen de ¿Puede la Junta Electoral Central establecer límites al ejercicio del derecho de sufragio de las personas con discapacidad? Análisis jurídico-constitucional de la Instrucción 7/2019, de 18 de marzo

El presente trabajo aborda el importante avance en los derechos de las personas con discapacidad auspiciada, principalmente, por la ratificación por el Estado español de la Convención Internacional de los Derechos de las Personas con Discapacidad. En concreto, nos centraremos en el reconocimiento del derecho de sufragio en condiciones de igualdad, llevada a cabo por la modificación de la LOREG por la Ley Orgánica 2/2018, de 5 de diciembre, mediante la que se elimina las limitaciones en el ejercicio del derecho de sufragio a las personas con discapacidad y se les reintegra de manera plena en su derecho. No obstante, y a pesar de la eliminación, la Junta Electoral Central ha emitido sendas instrucciones –Instrucción 5/2019, de 11 de marzo e Instrucción 7/2019, de 18 de marzo– que pueden incidir en el ejercicio del derecho de voto reconocido.

The present work addresses the important progress in the recognition of the rights of persons with disabilities sponsored by the ratification by the Spanish State of the International Convention on the Rights of Persons with Disabilities. Specifically, we will focus on the recognition of the right to vote under conditions of equality carried out by the modification of the LOREG by Organic Law 2/2018, of December 5th. By this modification, the limitations in the exercise of the right for people with disabilities are eliminated, and they are fully reinstated in their right. However, and despite the elimination, the Central Electoral Board has issued two instructions –Instruction 5/2019, of March 11 and Instruction 7/2019, of March 18– that may influence the exercise of the recognized voting right.
