El caso Mammadov contra Azerbaiyán constituye el primero en la historia del TEDH en el que el Comité de Ministros se ve obligado a activar el procedimiento de infracción del artículo 46 del CEDH por la falta de cumplimiento adecuado de una de sus sentencias por un Estado parte. Estrasburgo consideró que las medidas adoptadas por Baku no garantizaron la efectividad de su resolución, obligando al Comité a reprender al Estado para que adoptara la única medida que permitía un cumplimiento idóneo de la sentencia: la excarcelación inmediata del demandante.
The Mammadov case against Azerbaijan is the first in the history of the ECHR in which the Committee of Ministers must activate the infringement procedure of article 46 of the ECHR due to the lack of proper compliance with one of its sentences by a State party. Strasbourg considered that the measures adopted by Baku did not guarantee the effectiveness of its resolution, forcing the Committee to reprimand the State to adopt the only measure that allowed an adequate compliance with the sentence: the immediate release of the plaintiff.
