Resumen de El Asunto S.M. c. Croacia: del nuevo abolicionismo de la prostitución en el CEDH y del desastre interpretativo del TEDH

Con ocasión de la resolución del Asunto S.M. c. Croacia el Tribunal Europeo de Derechos Humanos parece haber descubierto una nueva violación de derechos humanos a garantizar a través del Convenio Europeo de Derechos Humanos. Si la Gran Sala confirma el razonamiento seguido en la sentencia, la prohibición de la explotación de la prostitución bajo los términos consagrados en la Convención para la Represión de la Trata de Personas y la Explotación de la Prostitución Ajena tendrá cabida en el alcance del Artículo 4 del CEDH. Sin embargo, esta introducción además de problemática parece revelarse como imposible.

On the occasion of the resolution of the Case of S.M. v. Croatia the European Court of Human Rights seems to have discovered a new human rights violation to be guaranteed by the European Convention on Human Rights. If the Grand Chamber confirms the reasoning followed in the judgment, the prohibition of the exploitation of prostitution under the terms enshrined in the Convention for the Suppression of the Traffic in Persons and of the Exploitation of the Prostitution of Others will fall within the scope of Article 4 of the ECHR. However, this introduction, in addition to being problematic, seems to be impossible.
