    Esta investigación tiene por finalidad llevar a cabo un recuento de la jurisprudencia sobre la responsabilidad del Estado-Legislador, con el modesto propósito de esbozar el sistema imperante de la responsabilidad patrimonial del Estado por el hecho de la ley. Así las cosas se hará un análisis de una de las más recientes sentencias del Consejo de Estado que revolucionan la materia, al considerar la defraudación de la confianza legítima como un nuevo título de imputación de responsabilidad del legislador, diferente a los tradicionales. Para finalizar se propondrá un nuevo sistema de responsabilidad del Poder Legislativo, que delimite los eventos y la forma en que esté puede responder patrimonialmente, realizando con respeto, reparos a las sentencias proferidas por el Consejo de Estado, para llegar a una claridad en la materia, capaz de proporcionar un relativo nivel de seguridad jurídica.

    This research paper aims to recap the jurisprudence, about State-Legislator liability, with the modest purpose to outline the reigning system of State liability in the expedition of laws. By doing so, an analysis will be done of one the most recent rulings by the Council of State that is revolutionizing this subject, by considering that forfeiting legitimate trust is a new imputation title of legislator liability, besides from the traditional ones in this matter. Finally, a new legislative power liability system will be proposed, that can delimit the events and the ways in which the legislator could be patrimonially liable, performing, with respect, several reservations to the rulings uttered by the Council of State, to achieve a certain clarity in this subject, able to provide a relative level of judicial security
