    • This article aims to address the new categories of refugees, “economic refugees” and “environmental refugees." It consists in a dialogue search of these new categories about the guardianship system and refugee protection on international level, according to the 1951 Convention of Refugees and the Additional Protocol on the same subject in 1967. It will address the need for refugee legal concept enlargement, viewing new factual and social realities in the economic and climate change. The issue justification is in defining the approach brought by the 1951 Refugee Convention not to be extended to new categories, which are on the margins of human rights international protection. It was chosen to work in the construction of a deductive method, through literature review. Therefore, given the growth of migration flows across borders, the economic and “environmental refugees” must have minimum guarantees, supported by the human rights protection system.
