    Every day the number of legal claims related to the right to health are being filed by citizens, with the aim of requiring the State to act positively, granting them some benefit, either a supply of medicine or the performance of a emergency procedure, a place in the ICU, a hospital bed, prostheses, food supplements, surgery, examinations, among other benefits. Faced with this situation, a problem arises, on the one hand the State that has been inefficiently fulfilling its obligation to guarantee everyone the full right to health and on the other hand the citizen with their right and dignity violated, having to help themselves through Judiciary to seek the realization of their right to health. In spite of the fact that the right to health is guaranteed by the Constitution, being a fundamental and social right, citizens do not always have their right in this sphere. So, what we have left is to fight so that every day it can become more satisfying to citizens by providing everyone with a more dignified life with conditions of survival.

    O presente artigo tem o objetivo de analisar as principais inovações que podem ser considerada como uma nova dimensão de Direito. Contudo, o enfoque será dado ao seu papel na defesa do direito das mulheres, direito esse também colocado em destaque pelas inovações da Lei 11.340 de 07 de agosto de 2006. O grande desafio mostrado neste estudo é como uma sociedade contemporânea influencia diretamente o enfoque do direito. Consoante as inovações que exigem uma atitude de todos para o enfrentamento dos problemas gerados que historicamente consideram a mulher como ser inferior em relação aos homens. A iniciativa de alguns países com a criação de legislação que proteja direitos objetivos e subjetivos, enquanto em outros países por questões culturais e religiosos são supridos ou ignorados
