Resumen de El Tribunal de Justicia Europeo y la Supreme Court de los Estados Unidos vis-à-vis a los Tribunales Estatales: reflexiones sobre el federalismo judicial en la Unión Europea

  El trabajo interpretativo del Tribunal de Justicia de la Unión Europea, por un lado, y de la Supreme Court estadoundense, por otro, parece ser el punto de partida de un análisis que, a partir de algunas de las categorías del federalismo judicial, parte de la geografía jurídica y conduce a la mejora de una identidad comun. En primer lugar, se evaluará la posible conciliación del sistema judicial europeo con el de un sistema federal, en particular a través de sus posibles similitudes con el federalismo judicial estadounidense. Para ello, será útil comparar algunos de los mecanismos procedimentales concretos en ambos sistemas jurídicos. A lo largo de estas líneas, y a través de un posible marco ‘federal’ en el diálogo multinivel entre los Tribunales estatales y supranacionales en el sistema jurídico europeo, se potenciará la posible aparición de un federal judiciary continental, con sus propias características distintivas.

  The interpretative work of the Court of Justice of the European Union, on the one hand, and the United States Supreme Court, on the other, seems to be the starting point of an analysis that, departing from some of the categories of judicial federalism, starts from the legal geography and leads to the improvement of a common identity. First of all, the possible conciliation of the European judicial system with that of a federal system will be evaluated, in particular, through its possible similarities with American judicial federalism. To this end, it will be useful to compare some of the specific procedural mechanisms in both legal systems. Along these lines, and through a possible ‘federal’ framework in the multilevel dialogue between state and supranational courts in the European legal system, the possible emergence of a continental federal judiciary – with its own distinctive features – will be promoted.
