El artículo ofrece una visión histórica de la mujer convicta a través de cuatro puntos objeto de análisis: las penas diferenciadas que se imponían en España; la evolución de las teorías sobre la delincuencia femenina; la creación de las Galeras, las Casas de Misericordia y las Casas de corrección; Concepción Arenal y Victoria Kent, dos figuras esenciales de la evolución feminista del sistema penitenciario. A través de este recorrido se pretende hacer una visión de género de la perspectiva jurídico social de la mujer delincuente, para ver cómo en nuestros días este pensamiento androcéntrico pervive en la forma de entender las cárceles actuales.

This is a complete overview about the convicted women through Spanish history. Focusing in the analysis of four determinant events: the inequality existing in the imposition of the sentences, the development of the female delinquency theories, the creation of institutions such as Las Galeras, Las Casas de Misericordia and the reformatory homes, finalising with Concepción Arenal and Victoria Kent as two of the most important figures in the feminist penitentiary thinking. This is a walk through the social and legal perspective of the female delinquency that takes us to the present day, carrying within the androcentric point of view found nowadays when approaching the peninteciary system.
