    The abbreviated judgment is characterized by the defendant's acceptance of a "state of the proceedings" judgment, that is, a reduction in the guarantees of the trial judgment against a favorable sanctioning treatment. From this derives the consequence that the public prosecutor can proceed to adjust the charge through supplementary disputes only with reference to the new facts that emerged during the trial and not with regard to facts already deduced from the preliminary investigation documents and not connected to the outcome of the aforementioned investigative documents

    Il giudizio abbreviato è caratterizzato dall’accettazione da parte dell’imputato di un giudizio “allo stato degli atti” e cioè della riduzione delle garanzie del giudizio dibattimentale a fronte di un trattamento sanzionatorio di favore. A ciò consegue che il pubblico ministero può procedere ad adeguare l’imputazione attraverso contestazioni suppletive unicamente con riferimento ai fatti nuovi emersi nel corso del giudizio e non con riguardo a fatti già desumibili dagli atti delle indagini preliminari e non collegati all’esito dei predetti atti istruttor
