La protección del paisaje a través del ordenamiento ecológico del territorio

    La protección, gestión y ordenación del paisaje en México es un tema de actualidad, el cual tiene un amplio campo para intervenir doctrinal y legalmente. Aunque podemos observar que el paisaje va de la mano con la protección de la naturaleza, el control y eliminación de la contaminación, el combate al cambio climático; el Derecho ambiental no le ha brindado la misma dedicación ni atención limitándolo a la consideración únicamente indirecta de un bien jurídico tutelado por el Estado, el cual no se encuentra contemplado en el texto constitucional reduciéndolo a asociarse indirectamente con las reformas de los artículos 27 y 73 las cuales tratan sobre la protección integral del medio ambiente. Tomando lo anterior en cuenta, los legisladores mostraron interés en el tema sometiendo a consideración del Congreso de la Unión la Iniciativa con Proyecto de Decreto titulada “Ley de Protección del Paisaje Histórico y Cultural en México” la cual busca la correcta gestión y tutela del paisaje en el país, esta iniciativa fuertemente inspirada por el Convenio Europeo del Paisaje. En este artículo abordaremos los antecedentes internacionales de la protección del paisaje como lo son Convenio para la Protección de la Flora, de la Fauna y de las Bellezas Escénicas Naturales de los Paisajes de América y el Convenio Europeo del Paisaje, este último es fundamental ya que traza la protección integral del paisaje, integrando tanto el patrimonio cultural como el natural. A su vez analizamos el paisaje en el Derecho comparado, abordando diferentes legislaciones latinoamericanas así como la Iniciativa Latinoamericana del Paisaje y la legislación nacional.

    Protection, management and planning of the landscape in Mexico is a relevant issue, which has a wide field to intervene doctrinally and legally. Although we can observe that the landscape goes hand in hand with the protection of nature, the control and elimination of pollution, the fight against climate change; environmental law has not given it the same dedication or attention, limiting it to the only indirect consideration of a legal good protected by the State, which is not contemplated in the constitutional text, reducing it to being indirectly associated with the reforms of articles 27 and 73, which deal with the integral protection of the environment. Taking the above into account, the legislators showed interest in the issue by submitting for consideration of the Congress of the Union the initiative with a draft decree entitled "Law for the Protection of the Historic and Cultural Landscape in Mexico" which seeks the proper management and protection of the landscape in the country, this initiative strongly inspired by the European Landscape Convention. In this article we will address the international background of landscape protection, such as the Convention for the Protection of the Flora, Fauna and Natural Scenic Beauties of the Landscapes of the American Landscape and the European Landscape Convention, latter being fundamental because it outlines the comprehensive protection of the landscape, integrating both cultural and natural heritage. We will also analyze the landscape in comparative law, addressing different Latin American legislations as well as the Latin American Landscape Initiative and national legislation.
