se ilustran brevemente algunos límites imprescindibles que los Estados de inmigración están obligados a respetar, no obstante presuman de una domestic jurisdiction sobre el tema de la expulsión. Tales límites, en el respeto de las eventuales obligaciones internacionales asumidas, se pueden resumir en tres aspectos fundamentales: la prohibición de la tortura o el trato inhumano y degradante (art. 3 de la Convención Europea de los derechos Humanos y de las Libertades Fundamentals - CEDU), la tutela de las personas vulnerables y el respeto de la vida privada y familiar (art. 8 de la CEDU). Estos tres aspectos de la ecología humana subrayan tanto la hipótesis según la cual para ser un extranjero regularmente residente en el territorio de un Estado, no es suficiente estar oficialmente admitido, como la imposibilidad de anticipar, en términos absolutos, las razones de la persistencia de la inmigración regular.

The article briefly illustrates some essential limits that immigration States are bound to observe even as they claim domestic jurisdiction in the matter of expulsion of persons from their territory. These limits, in further compliance with any international commitments made by the State, can be traced back to three fundamental aspects: the prohibition of torture or inhuman and degrading treatment (Article 3 of the European Convention for the Protection of Human Rights), the protection of vulnerable persons and respect for private and family life (art. 8 of the ECHR). These three aspects of human ecology underline the hypothesis that to be a lawfully resident alien it is not enough to have been officially admitted into the territory of the State, just as much as they do highlight the impossibility of putting forward in absolute terms the reasons for the persistence of irregular immigration.
