    Es clara la inexistencia de un régimen que rija la explotación de los recursos naturales en el espacio, la Luna y otros cuerpos celestes. La crisis ambiental y energética, así como los avances tecnológicos que permiten la explotación y extracción de recursos en la Luna y otros cuerpos celestes son circunstancias que propician la creación de un régimen jurídico que rija la explotación de los recursos naturales en el espacio. Dicho régimen tendrá que estar en armonía con todo el cuerpo normativo del derecho del espacio, en especial de la base de la no apropiación de los recursos naturales, y debe ser consensuado por todos los Estados, siempre y cuando ello se haga en beneficio de la humanidad. Es decir, surgiría una explotación permitida.

    It is clearly noticeable the inexistence of a statute governing the exploitation of natural resources in Outer Space, the Moon and other Celestial Bodies. The environmental and energy crises, as well as technological advancements allowing exploitation and extraction of resources in the Moon and other Celestial Bodies are circumstances that foster the creation of a legal regime governing exploitation of natural resources in Outer Space. The aforesaid regime must be in alignment with all the sets of rules of Outer Space Law, especially the tenet of no appropriation of natural resources, while such regime must be result from the agreement of all States, provided the same is conducted for the benefit of humanity. In other words, there would be restricted explotation.
