Resumen de Estado Mundial e direito internacional em Hans Morgenthau

This article revisits one of the cen‑ tral topics of Hans Morgenthau’s realism – the world state – as a major gateway to one of the most neglected areas in the current historiography of the realist tradition: that of internatio‑ nal law. The article thus argues that Morgenthau’s realism can be read in light of Locke’s metaphysical chal‑ lenge to Hobbes’ view of the state of nature. National interest can in this light be seen as highly conditioned by the republican ideal of popular sove‑ reignty – akin to that of limited gover‑ nment – where law is already operating socially, even before being posited by the state. By developing this parallel with Locke – shared in part by German legal philosophy that preceded Mor‑ genthau – we are in a better position to understand how he accommodates the functional approach in his realist take on international law and on the social prerequisites of a world state.

A proposta de releitura aqui sugerida retoma um dos temas cen‑ trais do realismo de Hans Morgenthau – o Estado Mundial – como forma de abordar uma das áreas mais negligen‑ ciadas da historiografia revisionista: o direito internacional e o seu poder normativo. O argumento desenvolvido é que o realismo de Morgenthau recu‑ pera a digressão metafísica de Locke contra o contratualismo individualista de Hobbes. Este desvio metafísico funda um ideal de soberania popular que qualifica o conceito de interesse nacional proposto por Morgenthau. Só traçando este paralelo com Locke podemos compreender o modo como Morgenthau acomoda o funcionalismo na sua teoria realista do direito inter‑ nacional, e na sua reflexão sobre as condicionantes sociais da construção de um Estado Mundial.
