La libertad religiosa del menor y el ejercicio de la patria potestad

    El nuevo mapa sociojurídico de España, con la inmigración y la aparición de personas de distintas confesiones y creencias, ha producido una importante modificación en la mentalidad pre-existente y en la Legislación concerniente al ejercicio de los derechos personalísimos, pudiendo producirse colisiones con la normativa en vigor. Constituye el punto de partida del presente trabajo los menores, que poseen un estatus especial, y el límite que constituyen las creencias religiosas en la potestad ejercidas sobre ellos, incluyendo dentro de las mismas la patria potestad y las diferentes instituciones tuitivas supletorias de la anterior. Se abordará el tema de la educación religiosa que los padres quieren inculcar a sus hijos, y la viabilidad de la misma, así como aquellos casos en los que el menor profesa una confesión distinta a la de sus progenitores.

    The new socio-legal map of Spain, with immigration and the appearance of people of different confessions and beliefs, has produced an important modification in the pre-existing mentality and in the Legislation related to the exercise of personal rights, which can collide with the regulations in force. The starting point of the present work constitutes minors, who have a special status, and the limit that constitutes religious beliefs in the power exercised over them, including within them the parental authority and the different supplementary tweet institutions of the previous one. It will address the issue of religious education that parents want to instill in their children, and the viability of it, as well as those cases in which the minor professes a confession different from that given by the parents.
