    A través de la sentencia objeto de estudio, se analizan varias cuestiones. Primero, si vulnera el derecho a la libertad sindical el condicionamiento de un beneficio empresarial a la afiliación a un sindicato, en concreto la AFE. Segundo, si es necesario para la ostentación de la legitimación activa que el sindicato demandante tenga implantación suficiente y finalmente, si un sindicato puede tener conexión con el objeto litigioso cuando este nació con posterioridad al acuerdo.

    The Laboral Superior Tribunal Judgment analyses various questions. Firstly, if its a vulneration of the right to freely associate that a benefit is conditioned to be part of a certain union, in this case “AFE”. Secondly, if its a requiremente of the active legitimation to have enough implantation, and finally, if its posible that the union has conexión with the object of the trial if the agreement was made before the union was created.
