Durante la primera mitad del siglo XIX aparecen variadas críticas a la teoría constitucional británica dominante del siglo XVIII, y a su máximo exponente: William Blackstone (1723-1780). La obra del polifacético Walter Bagehot tendrá especial trascendencia en los autores de la segunda mitad del siglo por su explicación supuestamente científica, alejada de las grandes construcciones filosóficas. La Constitución Británica se describe a través de los incentivos de los distintos agentes: la Cámara de los Comunes, la opinión pública, los public servants, la aristocracia, el monarca. El resultado es una visión optimista de las instituciones británicas, que enfatiza el rol de la historia.

During the first part of the XIX century appeared several critics to the constitutional theory of the XVIII century, with William Blackstone (1723-1780) as the major figure. The thought of a multifaceted Walter Bagehot enjoyed special significance in the eyes of the authors of the second half of the century due to his supposed scientific explanation, away from high philosophic constructions. The British Constitution is described through the incentives of the main agents: the House of Commons, public opinion, public servants, the aristocracy, the monarch. The result is an optimist vision of British institutions, which stresses the role of history.
