    Objective of the study: To analyze the reflexes of the catastrophe of the Fundão dam in Mariana - MG - in contemporary Brazilian society, with emphasis on the identity of the subjects belonging to the affected population and on the national legal system.

    Methodology / approach: The approach is qualitative with an exploratory phase based on bibliographic research, followed by an analytical descriptive phase supported by the deductive method.

    Originality / Relevance: Explain the identity values of the subjects victimized by the rupture of the Fundão dam in Mariana, Minas Gerais, based on Stuart Hall's concepts of identity.

    Main results: From the survey of the values and suggestion of rescuing the identities in question, an approximation of the behavior of the Law, norms and guidelines in relation to the major mining projects in Brazil and how they are being treated in the administrative sphere, where the discretion of acts prevails.

    Theoretical / methodological contributions: Defense of the Principle of Licensing Security in the Human Perspective, consolidating proactive protection measures.

    Social / management contributions: Proposal to prohibit the method of constructing dams upstream and respecting the identity values of the population affected by the undertaking, as well as the transfer to those interested in the construction of the dams the obligation to bear the prior safety expenses , where only after the adoption of these measures will it be possible to start operations of potential risk.

    Objetivo do estudo: Analisar os reflexos da catástrofe da barragem de Fundão em Mariana – MG - na sociedade brasileira contemporânea, com ênfase na identidade dos sujeitos pertencentes à população atingida e no ordenamento jurídico pátrio.

    Metodologia/ abordagem: A abordagem é qualitativa com uma fase exploratória fundada na pesquisa bibliográfica, seguida de fase descritiva analítica com suporte no método dedutivo.

    Originalidade/ Relevância: Explicitar os valores identitários dos sujeitos vitimados pelo rompimento da barragem do Fundão em Mariana, Minas Gerais, com base nos conceitos de identidade de Stuart Hall.

    Principais resultados: A partir do levantamento dos valores e sugestão de resgate das identidades em apreço, chegou-se a uma aproximação do comportamento do Direito, normas e diretrizes em relação aos grandes empreendimentos minerários no Brasil e como estão sendo tratados no âmbito administrativo, onde prevalece a discricionariedade dos atos.

    Contribuições teóricas/ metodológicas: Defesa do Princípio da Segurança Licenciária na Perspectiva Humana, consolidando medidas de proteção proativas.

    Contribuições sociais / para a gestão: Proposta de proibição do método de construção de barragens à montante e respeito aos valores identitários da população afetada pelo empreendimento, bem como, a transferência aos interessados na construção das barragens a obrigatoriedade de arcar com as despesas de segurança prévia, onde somente após adoção dessas medidas se poderá dar início às operações de potencial risco.
