    • In my country, Argentina, it is discussed if a Civil Judge must maintain a passive attitude or if he must be the director of the process. In my opinion, there is no doubt about the function of the Judge, he must be the ¿director or conductor of the process¿, moved away of the judge dictator, own of the revolutionary governments, who has big powers in front of the common citizen, far away from the watching judge who, with a passive attitude, it is limited to aplicate the law, moving away from reality. Therefore, he must make an suitable use of the duties that the law confers to him, in order to discover the material truth on the formal thing, even in officious way, in case of error or negligence of the justiciables.
