Resumen de Antijuridicidade como requisito da responsabilidade civil extracontratual: amplitude conceitual e mecanismos de aferição

  The present study aims to explore the multiple facets of wrongfulness in tort law. First, there is great uncertainty about the nomenclature used to designate the institute, especially when confronted with the term “ilicitude” in latin languages, generating a comparison between objective wrongfulness and subjective wrongfulness.

  The contrast between formal wrongfulness and material wrongfulness will help the reader to assess the content of the institute. The present work also aims to identify the operative locus of wrongfulness (which is in the fact that caused the damage), as well as the method of effectively verifying the existence of wrongfulness in a certain conduct, exploring the content of the theory of the violation of a duty of care and the theory of wrongfulness based on the result. Finally, the role of wrongfulness as a requirement of Tort Law is pointed out.

  O presente estudo visa a analisar as múltiplas facetas da antijuridicidade na responsabilidade civil extracontratual. Primeiramente, existe uma grande incerteza sobre a nomenclatura utilizada para designar o instituto, principalmente quando confrontado com o termo “ilicitude”, gerando a comparação entre a ilicitude objetiva e a ilicitude subjetiva. Outrossim, o contraste entre as ilicitudes formal e material auxiliará o leitor a aquilatar o conteúdo do instituto da antijuridicidade. O presente trabalho ainda visa a identificar o locus operacional da antijuridicidade, que está no fato causador do dano, bem como o método de efetiva verificação da existência de antijuridicidade em determinada conduta, explorando o conteúdo das teorias do desvalor da conduta e do desvalor do resultado. Por fim, aponta-se o papel da antijuridicidade como pressuposto ou requisito da responsabilidade civil extracontratual.
