Resumen de Resolução por onerosidade excessiva: pressupostos e disponibilidade

This article, which reproduces a lecture given at the II International Private Law Conference, organized by the Private Law Institute in association with the São Paulo Lawyers Assoaciation (AASP), held on October 19 and 20, 2017, aims to systematize the assumptions to face the excessive burden proposing an analysis of those explicitly set forth in article 478 of the Brazilian Civil Code, as well those assumptions implicitly established in the codified system.
Secondly, this article examines the possibility of the parties to negotiate on excessive burden, either to restrict or to amplify its application by mutual agreement.

O presente artigo, que reproduz palestra proferida no II Congresso Internacional de Direito Privado, organizado pelo Instituto de Direito Privado em parceria com a Associação dos Advogados de São Paulo (AASP), realizado nos dias 19 e 20 de outubro de 2017, tenta sistematizar os pressupostos para enfrentar a onerosidade excessiva propondo um exame daqueles explicitamente previstos no artigo 478 do Código Civil, bem como os implicitamente previstos no sistema codificado. Em uma segunda parte, examina a possibilidade de as partes disporem do instituto seja para alargar sua incidência (disponibilidade a maior), seja para estreitá‑la (disponibilidade a menor).
