El alojamiento colaborativo y la reconfiguración de la economía colaborativa desde una nueva perspectiva jurídica

    En el presente artículo trataremos de fijar los límites jurídicos del llamado alojamiento colaborativo a través de la reconfiguración del fenómeno socioeconómico del que, en principio, tiene origen; es decir, de la mal llamada economía colaborativa. De este modo, delimitando qué entendemos por economía colaborativa, será posible identificar el marco jurídico en el que se inscriben, consecuentemente, los alojamientos que, verdaderamente, se pueden calificar como colaborativos, estableciendo los límites con respecto a los arrendamientos vacacionales, alquileres turísticos y los intercambios de viviendas.

    In this article we will expose a (necessary) reconfiguration of the concept of sharing economy from two different perspectives. First, we will redefine the concept of sharing economy according to a literal interpretation of the concept based on a non-profit principle or the absence of an economic exchange (pecuniary or non pecuniary). Then and from a conceptual standpoint, we will propose the use of an alternative term, circular economy 2.0- instead of sharing economy- to conceptualize a socio-economic phenomenon that exceeds the act of collaborating.

    Thus and finally, we will study the main consequences of the reconfiguration of the concept in one of its major constituent sectors: collaborative housing.
