    The protection of the right to a healthy environment before the European Court of Human Rights is the result of a remarkable constructive case law. Nevertheless, it is hampered by certain limits, both substantive and procedural. There is scope for strengthening it, provided that the Court takes greater account to the other international and European sources and that it gives full effect to the growing European consensus regarding the importance of this right.

    Issue d’une construction jurisprudentielle remarquable, la protection du droit à un environnement sain devant la Cour européenne des droits de l’Homme se trouve néanmoins entravée par certaines limites, tant substantielles que procédurales. Des perspectives de renforcement sont envisageables à condition que la Cour fonde davantage son interprétation sur l’apport des autres sources internationales et européennes en la matière et qu’elle donne plein effet au consensus européen grandissant autour de l’importance de ce droit.
