    Negli ultimi anni, il mandato di arresto europeo ha rappresentato il terreno di elezione per un ampio confronto tra Corte di giustizia e Corte EDU, sul versante della tutela dei diritti fondamentali. A seguito di un’iniziale distanza tra le medesime, si sta assistendo a una reciproca convergenza, nella prospettiva di garantire i diritti, tanto del ricercato, quanto della vittima del reato. Il presente articolo si pone l’obiettivo di ricostruire questa evoluzione giurisprudenziale, attraverso un’analisi dei principali arresti fino a giungere a due recenti sentenze, le quali rappresentano il punto di arrivo del processo di avvicinamento delle due Corti europee.

    Over the last few years, the European Arrest Warrant has been the breeding ground for a broad confrontation between the Court of Justice and the ECtHR on the protection of fundamental rights. After an initial distance between them, we are witnessing a mutual convergence in order to guarantee the rights of both the requested person and the victim of crime. This article aims to reconstruct the development of the case law, through an analysis of the main judgments up to tworecent cases, which represent the arrival point of the process of rapprochement between the two Courts.
