On the noxal liability of the naked owner. According to an ancient and undisputed opinion the owner of a servus fructuarius could be sued noxally only if he had hired the slave from the usufructuary. The author aims at remediating this view by arguing that the owner of a servus fructuarius was already as such noxally liable if he was able to surrender the slave to the victim.
