Resumen de La respuesta del sistema penitenciario español ante el fenómeno de la radicalización yihadista

En el contexto de la lucha contra el terrorismo, las prisiones han recibido una atención creciente durante las dos últimas décadas al ser consideradas como espacios aptos para la radicalización yihadista. En este sentido, el objetivo fundamental de este artículo es examinar cuál ha sido la respuesta del sistema penitenciario español frente a este fenómeno. Para ello, en primer lugar, se abordan las causas y principales implicaciones que plantea la radicalización yihadista en las prisiones. Posteriormente, se examinan de forma específica los tres instrumentos sobre los que, en la actualidad, se sustenta la respuesta del sistema penitenciario español. Finalmente, se realizan una serie de conclusiones en las que se sostiene que, incluso desde una visión pragmática que anteponga la búsqueda de eficacia a la legitimidad, la naturaleza excepcional y esencialmente securitaria de tal respuesta no resulta idónea.

In the context of the fight against terrorism, prisons have received increasing attention over the past two decades for being considered as suitable places for jihadist radicalization. In this sense, this work seeks to analyse the response which the Spanish Prison System has developed against this phenomenon. For that purpose, the causes and main implications of jihadist radicalization in prisons are firstly addressed. Thereupon, the three instruments in which the Spanish Prison System´s response is currently based are examined. Finally, some conclusions are presented, being argued that, even from a pragmatic vision that puts the search of effectiveness before legitimacy, the exceptional and essentially securitarian nature of this response is not appropriate.
