O direito de morrer e os desafios trazidos pela evolução da ciência no século XXI

    There are many issues that are being raised at the beginning of this century, especially due to the great scientific and technological advances that society has experienced in recent decades. Such evolution brings changes and improvements to daily life, completely changing social relations, but brings new challenges, such as the definition and implementation of the right to die with dignity. Securing the right to a dignified death is debated, especially when there is the presence of incurable and terminal illnesses that bring great suffering to the individual. However, the lack of dialogue on the right to die, as well as the absence of legislation on the subject, makes the family and the medical team have difficulties to act, even when the patient himself, using the autonomy of will, is manifested by orthothanasia. The 21st century brings new contours to the right to liberty, and, in the absence of specific laws, cases questioning such limits are reaching the Courts around the world, including Brazil. This research aims to analyze questions about the freedom of choice and the patient's autonomy of will in the face of the terminality of life and the realization of human dignity, even before the end. To this end, a qualitative research of bibliographic review was performed.

    Existem muitas questões que estão sendo trazidas nesse início de século, em especial devido ao grande avanço científico e tecnológico que a sociedade tem experimentado nas últimas décadas. Tal evolução traz mudanças e melhorias para o cotidiano, mudando completamente as relações sociais, porém traz novos desafios, como a definição e efetivação do direito de morrer com dignidade. Garantir o direito à uma morte digna é debatida, em especial quando há a presença de doenças incuráveis e terminais, que trazem grande sofrimento ao indivíduo. No entanto, a falta de diálogo sobre o direito de morrer, assim como ausência de legislação sobre o tema faz com que a família e a equipe médica tenham dificuldades para agir, mesmo quando o próprio paciente, utilizando a autonomia de vontade, se manifesta pela ortotanásia. O século XXI traz novos contornos ao direito de liberdade, e, na falta de leis específicas, casos questionando tais limites estão chegando aos Tribunais de todo o mundo, inclusive no Brasil. A presente pesquisa tem o intuito de analisar questões a respeito da liberdade de escolha e a autonomia de vontade do paciente diante da terminalidade da vida e a efetivação da dignidade humana, mesmo diante do fim. Para tanto foi realizada pesquisa de qualitativa de revisão bibliográfica.
