El objeto de este trabajo es contrastar el régimen de implantación de las instalaciones de suministro de combustible tradicional y el de energías renovables, con vistas a identificar las dificultades existentes para el despliegue de las segundas. En primer lugar, se expone el régimen jurídico de las instalaciones de combustibles fósiles, partiendo de su consideración como infraestructuras asociadas a la prestación de un servicio de interés económico general. Tras ello, en segundo lugar, se examinan las previsiones normativas más recientes sobre la implantación de las instalaciones de suministro de combustibles alternativos; entre otras las del proyecto de Ley de Cambio Climático y Transición Energética (2020). El trabajo concluye la necesidad de operar cambios normativos que faciliten la extensión de las instalaciones de suministro de energías limpias y así propiciar realmente la movilidad sostenible.

This work focuses on a critical analysis of the organization of these activities in the Canary Islands and, consequently, on the positive and negative aspects of the aquaculture activity, as well as the opportunities for an adequate maritime spatial planning. Actually, it can be seen how in the last years the Canary Islands has shown a strong desire for renewal and adaptation to European demands, thanks to important regulatory changes. Despite this, the new regulation does not seem able to solve the problems that entrepreneurs encounter in order to exploit the activity in the aquaculture sector. That’s because the new regulation is linked to the existing one without clarified a consistent application. It has not provided, indeed, the adequate responses to the new needs that arise in this sector. As we will have occasion to point out, the current procedures are complex, long in time and, above all, sometimes contradictory to each other. Such inconveniences delay the potential development of aquaculture in the Canary Islands, which, as shown in the analysis of the Multiannual Strategic Plan for Spanish Aquaculture 2014-2020, seems very encouraging. These are the problems that will be analysed in the present work, taking into account the great opportunity that this sector represents for the Canary Islands, given its geographical, oceanographic and strategic position, in order to be able to develop it in a constant and efficient way.
