La sentencia del Tribunal Superior de Justicia de Madrid de fecha 1 de octubre de 2019 anula un laudo por violación del orden público, basándose en que el laudo en cuestión adolecía de arbitrariedad por ser incoherente con el hecho de que el tribunal arbitral, a pesar de reconocer la existencia de un incumplimiento de las obligaciones de información y transparencia que la ley impone al banco, no acuerda la indemnización de los daños y perjuicios causados al cliente. Surgen algunas dudas sobre la existencia de una real violación del orden público y consecuentemente de las razones para anular el laudo.
The decision of the High Court of Justice of Madrid, dated October 1, 2019 voided an award for violation of public policy, on the grounds that the award in question was arbitrary because it was inconsistent with the fact that the arbitral tribunal did not grant any compensation for the damages caused to the client, despite admitting the existence of a breach of the information and transparency obligations that the law imposes on the bank. Some doubts arise as to the existence of a true violation of public order and, consequently, as to the reasons for setting aside the award.
