Durante la Guerra de la Independencia la Constitución de Cádiz casi no pudo aplicarse debido tanto a la ocupación francesa como al poder constituyente e ilimitado de que dispusieron las Cortes. Así pues, el Trienio Liberal (1820-1823) puede considerarse como la primera ocasión en la que la Constitución de Cádiz se aplicó realmente. Sin embargo, entre 1814 (cuando Fernando VII había abolido la Constitución) y 1820 (cuando fue de nuevo restablecida) muchos liberales habían cambiado su pensamiento político, al punto de que el liberalismo se había quebrado en dos grupos: uno de liberales exaltados, próximos al jacobinismo, y otro de moderados, ligados al sistema constitucional inglés. De resultas, estos grupos interpretaron la forma de gobierno de la Constitución de Cádiz ajustándola a su particular ideario político. Y ambas lecturas de la Constitución distaban de coincidir con la que habían tenido en mente los constituyentes cuando habían aprobado el texto.

During the War of Independence the Cadiz Constitution was barely applied due both to the French occupation of the Spanish provinces and the constituent and unlimited power of the Cortes. So, the “Trienio Liberal” (1820-1823) may be seen as the first time that the Cadiz Constitution was really applied. Nevertheless, between 1814 (when the Constitution had been abolished by Fernando VII) and 1820 (when it was restored) many liberals had changed their political thought, and in fact liberalism was broken into two groups: a group of radical liberals were next to jacobinism, while moderate liberals were close to English constitutional system. As a result of this, the Cadiz Constitution’s frame of government was interpreted by these different groups using their own political thought. And both constitutional readings were not the same that founding fathers had in their minds when they had passed the Constitution.
