Resumen de La diversificación del trabajo a distancia tras el Real Decreto-Ley 28/2020

El reciente Real Decreto-ley 28/2020, aprobado en el marco de la crisis de la COVID-19, ha venido a regular el trabajo a distancia, si bien también comporta la diversificación de ese mismo tipo de trabajo. Y ello, por cuanto dicho RDL solo se centra en el trabajo a distancia por cuenta ajena, que se desarrolla en el sector privado y que, además, no está vinculado a la crisis de la COVID-19. Por tanto, tras su aprobación no existe legalmente un solo tipo de trabajo a distancia, sino varios: el ordinario o “post-covid” (regulado en el RDL), el surgido durante la primera ola de la crisis de la COVID-19 y que se mantiene en la actualidad, el desarrollado en el marco de las Administraciones Públicas, el desempeñado de forma autónoma, el transnacional y el regulado por los convenios colectivos vigentes en el momento de la entrada en vigor del RDL 28/2020 (el trabajo a distancia convencional). Obviamente, esta diversidad de tipos de trabajo a distancia y su diverso régimen jurídico, augura algunos retos y problemas.

The recent Royal Decree-Law 28/2020, approved in the context of the crisis of COVID-19, has come to regulate distance work, although it also involves the diversification of this same type of work. This is because the RDL only focuses on distance work for employees, which is developed in the private sector and not linked to the crisis of the COVID-19. Therefore, after its approval, there is not just one type of distance work, but several: ordinary or post-covid work (regulated by the RDL), that which arose during the first wave of the COVID-19 crisis and which is still in force today, that which is developed within the framework of public administrations, that which is carried out autonomously, that which is transnational and that which is regulated by the collective agreements in force at the time of the entry into force of RDL 28/2020 (conventional distance work). Obviously, this diversity of types of distance work and its diverse legal regime, augurs certain challenges and problems.
