L'incerto ambito applicativo dei diritti della persona offesa nel procedimento cautelare ad personam

    The analysed verdict, confirmed that a failed notification of the offended person with the request for work authorization of the accused subject - being under a house arrest - does not determine the inadmissibility of the motion, in case that between the offended person and the one under investigation there is no previous relationship and it does not subsist danger of personal recidivism.

    It would therefore seem to consolidate the case law that combines the informative and participatory rights of the offended person ex art. 299, par. 3, of the Italian Criminal Code to relational contexts between the offended and the accused. With that being said, the risk of recurrence of violent conduct can be greater in this type of case, so the protective needs take on importance and justify the rights of the victim. However, the defendant remains at the mercy of divergent orientations of the magistrate. Eventually, without having an actual certainty of the procedure to follow in order to obtain the revocation or the stand-down of the coercive restrictions.

    La pronuncia in commento ha ribadito che l’omessa notifica alla persona offesa della richiesta di autorizzazione a svolgere l’attività lavorativa dell’accusato sottoposto agli arresti domiciliari non determina l’inammissibilità dell’istanza se tra la persona offesa e l’indagato non vi è un rapporto pregresso e non sussiste il pericolo di recidiva personale. Sembrerebbe, quindi, consolidarsi l’orientamento interpretativo che unisce la speciale tutela informativa e partecipativa dell’offeso ex art. 299, comma 3, c.p.p. a contesti relazionali fra l’offeso e l’accusato poiché è in questo tipo di situazioni che il rischio di reiterazione della condotta violenta può essere maggiore e le esigenze protettive che giustificano i diritti della vittima assumono rilevanza, tuttavia, l’istante rimane in balia di divergenti orientamenti pretori, senza avere effettiva certezza sulla procedura da seguire per ottenere la revoca o l’allentamento dei vincoli coercitivi.
