La confisca dei terreni e delle opere realizzate può essere disposta anche in presenza di una causa estintiva del reato, purché la sussistenza della lottizzazione abusiva sia stata (già) accertata sotto il profilo soggettivo ed oggettivo. Ma è condivisibile l’assunto secondo cui, intervenuta la causa estintiva, il giudizio non può proseguire ai soli fini di verificare i presupposti di applicazione della misura
