Nel corso degli ultimi anni, anche in adesione agli impulsi di matrice sovranazionale, il baricentro del procedimento penale italiano, storicamente incentrato sull’imputato, ha parzialmente mutato il proprio assetto, trovando nuovo perno sulla figura della vittima del reato, secondo una concezione vittimologica per lungo tempo riservata ad altri rami dell’ordinamento. Tra gli istituti processuali a vocazione protettiva vi è quello, cristallizzato nell’art. 299 c.p.p., dell’obbligo, per la parte richiedente la revoca o la modifica delle misure cautelari di cui agli artt. 282-bis e ss. c.p.p., di notificare l’istanza alla persona offesa o al suo difensore a pena di inammissibilità. In questa sede se ne illustrano i profili problematici, alla luce degli orientamenti divergenti emersi in dottrina e giurisprudenza.
In the last years, also because of international impulses, the balance of the italian criminal law procedure, historically based on the figure of the accused, has moved its balance onto the victim of the crime, according to a victimologic theory which has always been the base of other branches of law system. Among the procedural rules which aim to protect the victim, we will analyse art. 299 c.p.p., which obliges the requester of an annulment or a substitution of a preventive measure (artt. 282-bis e ss. c.p.p.), to communicate the request to the victim or to his lawyer, otherwise the request is not accepted. This essay will highlight the most problematic aspects of this rule, as interpreted by doctrine and courts.
