  • This work is intended to deal with the practical problems that arise in the executive phase of the process and within the attachment proceedings to fix the price of the goods that are to be subject of an auction. For this reason, it is necessary to determine if it will be necessary or not to perform a prior evaluation of the property, and in this case, the mechanisms for appointment of the expert witnesses, the way in which they have to carry out their work and the guarantees that the law offers for the parties in order to obtain a fair and quick mechanism that allows to set the price of the auctioned property. All this taking into account the procedural law, its practical application and the organizational environment in which the judicial process works
