Resumen de Praxis en la puesta en práctica del art. 152.1.2 LEC para optimizar los actos de comunicación

  Este trabajo analiza la nueva facultad atribuida a los procuradores por la reforma introducida en le Ley de Enjuiciamiento Civil por la Ley 13/2009, consistente en la posibilidad de que el procurador pueda realizar cualquier acto de comunicación contemplado en el art. 149 LEC tanto en la jurisdicción civil como en el resto de la jurisdicciones. Este análisis se realiza siguiendo el itinerario teórico propuesto por la propia LEC pero se recrea en el reflejo, después de un estudio de campo, de lo que ha sucedido en la práctica, cómo ha repercutido, su nivel de éxito y las posibilidades de mejora. Todo ello sin perder de vista que apenas ha transcurrido nueve meses desde su entrada en vigor y que se trata de un primer acercamiento para tomar el pulso de la situación.

  This paper examines the new power granted to the attorneys by the reform introduced by the Law 13/2009 in the Civil Procedure Act (LEC, Ley de Enjuiciamiento Civil), namely the possibility for the attorney to perform any act of communication referred to in the art.149 LEC both in the civil jurisdiction as in the rest of the jurisdictions. This analysis is performed along the theoretical route proposed by the own LEC but it recreates itself in the reflection, after a field study, of what has happened in the practice, which impact did it have, its level of success and the possibilities for improvement. All this without forgetting that just nine months has elapsed since its entry into force and that it is a first approach to see how the situation is developing.
