    En 2015 entró en vigencia el Código Civil y Comercial Argentino. Uno de los desafíos que se presenta a los jueces es asumir la consagración de los derechos humanos como fuente explícita del Derecho Civil y Comercial, y como criterio de interpretación. Este contexto jurídico alumbra una línea de investigación sociológica cuya finalidad consiste en indagar el estatus y el rol del juez a que da lugar el nuevo Código, como así también de conocer cuál es el margen de autonomía con que cuentan al momento de decidir los resultados de los litigios y en función de qué valores y principios ideológicos y jurídicos fundamentan sus pronunciamientos. Teniendo en cuenta las funciones judiciales instrumental, política y simbólica, y la normativa civil y comercial,  se reflexionará sobre el juez y la delicada y necesaria función que desempeña.

    In 2015, the Argentine Civil and Commercial Code came into force. One of the challenges for judges is to assume the consecration of human rights as an explicit source of Civil and Commercial Law, and as a criterion for interpretation. This legal context illuminates a line of socio-legal investigation whose purpose is to investigate the state and the role of the judge to whom the new Code gives rise, as well as to know what is the margin of autonomy that he has to decide the trials, and what ideological values ​​and principles and legal are the basis of their pronouncements. Taking into account the instrumental, political and symbolic judicial functions, and the civil and commercial code, the figure of the judge and the delicate and necessary role they play will be considered.
