    From the Immanuel Kant's thought of, in his work "kritik der reinen vernunft" starts the relation on the normative validity in Hans Kelsen. The neutrality founded to define the State and the Subject of Right are naturally linked to the structure of kantian criticism.To make the experience of a depersonalized rights essential, it is indispensable to observe the hypothetical and valuable judgments present in the structure of the law so that it may arrive at the modern definition of Sovereignty.

    A partir do prisma de Immanuel Kant, em sua obra "kritik der reinen vernunft“observa-se a relação sobre a validade normativa em Hans Kelsen. Neste, a neutralidade encontrada para definir o Estado e o Sujeito de Direito se encontram naturalmente ligados a estrutura da crítica kantiana. Para que seja fundamental a experiência de um direito despersonalizado, se faz indispensável a observação dos juízos hipotéticos e de valor presentes na estrutura do direito para que, assim, se chegue na definição moderna de Soberania.
