Con el presente trabajo, se propone, de lege ferenda, la limitación del derecho real de superficie a las construcciones. A fin de canalizar los supuestos de plantaciones y forestación, se propone su inclusión dentro del derecho real de enfiteusis, admitiendo el mismo en el derecho positivo vigente

With the present work, it is proposed, lege ferenda, the limitation of the real right of surface to the constructions. In order to channel the assumptions of plantations and afforestation, it ́s inclusion within the real right of emphytheusis is proposed, admitting the same in the current positive law
