Resumen de De donaciones ante nuptias a propter nuptias para una igualdad en el matrimonio romano

Con la realización del presente trabajo pretendemos investigar sobre la consideración jurídica que, a lo largo de la Historia de Roma, han tenido las donaciones nupciales; haciendo una especial referencia a la prohibición de donaciones a causa del matrimonio que se produjeron en la etapa clásica, motivado quizás al deseo de que el marido y la mujer fueran iguales y no se produjera un desequilibrio en el patrimonio de alguno de ellos. En este sentido, partiremos del concepto de donatio nuptialis en las fuentes jurídicas –considerado como acto de liberalidad–, sus caracteres, la posibilidad de que los futuros esposos la revocaran por conductas ingratas, así como ofreceremos una clasificación homogénea y lo más completa posible de las donaciones en función del momento matrimonial en el que tuvieran lugar. A tal efecto, finalmente, diferenciaremos entre: las donaciones nupciales simples u ordinarias; de las donaciones especiales ante nuptias y propter nuptias; arras esponsalicias; dote; y la pretium pudicitiae. Por ser consideradas todas ellas como tipos de donaciones o atribuciones patrimoniales a causa del matrimonio romano.

With the completion of this work, we intend to investigate the legal consideration that, throughout the History of Rome, the nuptial donations have had; making a special reference to the prohibition of donations due to marriage that occurred in the classical period, perhaps motivated by the desire that the husband and wife were equal and there was no imbalance in the heritage of some of them. In this sense, we will start from the concept of donatio nuptialis in legal sources –considered as an act of liberality–, its characteristics, the possibility of future spouses revoking it for ungrateful behavior, as well as offering a homogeneous classification and as complete as possible of donations depending on the marriage moment in which they took place. For that purpose, finally, we will differentiate between: the simple or ordinary nuptial donations; of the special donations ante nuptias and propter nuptias; drag sponsalicias; dowry; and the pretium pudicitiae. Because all of them are considered as types of donations or patrimonial attributions due to roman marriage.
