Resumen de El amicus curiae en serio: la modulación de la figura por el Tribunal Electoral del Poder Judicial de la Federación como instrumento de justicia abierta

  La justicia abierta es el futuro, y el futuro es ahora. Entonces, ¿cómo se implementa la justicia abierta? El Tribunal Electoral del Poder Judicial de la Federación ha desplegado esfuerzos para lograr una justicia cercana a las personas que cumpla con su función de protección y de defensa del proceso democrático. Para ello, aplica la filosofía y los principios del gobierno abierto en el ámbito de su competencia, entre los que destaca la participación en el sistema de justicia o participatory justice.

  Este estudio analiza la figura del amicus curiae o amigo del tribunal a partir de la línea jurisprudencial construida por el Tribunal Electoral. Así, es posible advertir que su adopción abre nuevos canales de participación que enriquecen la democracia deliberativa de opinión y participación en el proceso judicial al otorgar un mayor grado de legitimidad y transparencia a las resoluciones, por lo tanto, será necesario regular esta institución para hacerla verdaderamente efectiva

  Open justice is the future and the future is now. So how is open justice implemented? The Mexican Electoral Court of the Federal Judiciary has made efforts to achieve a justice close to the people, which fulfills its function of protection and defense of the democratic process. To do this, it applies the philosophy and principles of open government within the scope of its competence. Among these principles, participation in the justice system or participatory justice stands out.

  This study analyzes the figure of the amicus curiae or friend of the court, based on the jurisprudential line constructed by the Electoral Court. Thus, it is possible to perceive that the adoption of this figure opens up new channels of participation that enrich the deliberative democracy with opinions and participation in the judicial process, granting a greater degree of legitimacy and transparency to the resolutions and, therefore, it’s necessary to regulate this institution to make it truly effective
