Resumen de Procedimiento de adopción de medidas cautelares en materia de radio y televisión en procesos electorales locales

  El Tribunal Electoral del Poder Judicial de la Federación, en la jurisprudencia 23/2010, de rubro MEDIDAS CAUTELARES EN ELECCIONES LOCALES. CORRESPONDE DETERMINARLAS AL INSTITUTO FEDERAL ELECTORAL, TRATÁNDOSE DE PROPAGANDA DIFUNDIDA EN RADIO Y TELEVISIÓN, y en diversas sentencias, ha desarrollado un procedimiento para atender solicitudes de medida cautelar en materia de radio y televisión, por hechos presuntamente contraventores de normas estatales, con incidencia en un proceso local, cuestión retomada en el artículo 43 del Reglamento de Quejas y Denuncias del Instituto Nacional Electoral. Sin embargo, se considera que las autoridades jurisdiccionales y administrativas electorales han interpretado de manera distinta la facultad de los organismos públicos locales electorales para pronunciarse respecto a la procedencia o no de la solicitud de medida cautelar; la competencia de la Comisión de Quejas y Denuncias del Instituto Nacional Electoral para determinar su adopción o no, y el medio de impugnación procedente, entre otras cuestiones procedimentales

  The Mexican Electoral Court of the Federal Judiciary, In Jurisprudence 23/2010, entitled PRECAUTIONARY MEASURES IN LOCAL ELECTIONS, ITS DETERMINATION CORRESPONDS TO THE FEDERAL ELECTORAL INSTITUTE, REGARDING PROPAGANDA DIFFUSED ON RADIO AND TELEVISION, and through various judgements, the Tribunal has developed a procedure to attend requests for precautionary measures in the category of radio and television, for actions allegedly contravening local norms, with impact on a local process; issue regarded in article 43, of the Complaints Regulations of the National Electoral Institute. However, it is considered that the electoral authorities, both jurisdictional and administrative, have interpreted in a different way the attributions of the local public electoral organisms to grant or not the precautionary measures, the attributions of the Complaints Commission of the National Electoral Institute to grant them or not, and the corresponding means to challenge those decisions, among other procedural issues
