Cómputo bidireccional del número de trabajadores afectados en supuestos de extinción. A propósito de la sentencia del TJUE de 11 de noviembre de 2020

    Hasta la fecha, la doctrina jurisprudencial entendía que el artículo 51.1 ET establecía como norma general, que el día del despido constituye el día final del cómputo del primer período de noventa días y el inicial del siguiente. Es decir, el cómputo de trabajadores afectados se realizaba hacia atrás. A partir de la STJUE de 11 de noviembre de 2020 (Asunto C-300/19), que viene a suponer un cambio sustancial para el despido colectivo en España, establece que el periodo de referencia para determinar si un despido individual impugnado forma parte de un despido colectivo, no tiene que computarse, necesariamente, hacia atrás, sino que, de manera indistinta, será hacia atrás o adelante, siempre y cuando alcance la cifra legal exigida.

    To date, jurisprudential doctrine understood art. 51.1 ET stated as a general rule that the day of dismissal is the final day of the calculation of the first 90-day period and the initial day of the next. In other words, the counting of affected workers was done backwards. As from the Judgement of the ECJ of November 11, 2020 (Case C-300/19), which represents a substantial change for collective redundancies in Spain, it establishes that the reference period for determining whether a contested individual redundancy is part of a collective redundancy, does not necessarily have to be computed backwards, but, indistinctly, will be backwards or forwards, as long as it reaches the required legal figure.
