Resumen de Caso práctico: El régimen disciplinario aplicado a la educación online en el contexto covid-19

Se analiza, mediante la resolución del supuesto práctico expuesto, la aplicación del régimen disciplinario a un profesor de un Instituto de Educación Secundaria de la Comunidad de Madrid que suspende por decisión propia la actividad docente online en un contexto de enseñanza semipresencial, infiere por vía telemática graves acusaciones contra una alumna y su familia en presencia de los alumnos, desatiende las órdenes del director y dirige acusaciones y amenazas al equipo directivo mediante correo electrónico.
Se trata la garantía de la adecuada atención educativa en un contexto COVID-19 y las responsabilidades de los docentes, en coordinación con el coordinador TIC, en la utilización de las plataformas docentes. Se examina, además, la oportuna ponderación de las actuaciones de los profesores en el marco de la aplicación del procedimiento disciplinario mediante la aplicación de los principios de culpabilidad y presunción de inocencia.

The application of the disciplinary measures to a secondary school teacher in the Community of Madrid is analyzed by means of the resolution of the case study exposed. Said teacher, while in a context of blended teaching, suspends his online teaching activity of his own will, infers serious accusations online against a student and her family in the presence of the other students, disregards the principal’s orders and directs accusations and threats to the management team by e-mail.
It is about the guaranteeing of the adequate educational support in a COVID-19 context and the responsibilities of teachers, in coordination with the ICT coordinator, in the use of teaching platforms. It also examines the appropriate weighing of teachers' actions within the framework of the disciplinary procedure through the application of the principles of guilt and presumption of innocence.
