    Actualmente, las Instituciones Penitenciarias tienen atribuida una función de reeducación y reinserción social.

    El instrumento utilizado para desempeñar esta finalidad es el tratamiento penitenciario, que se inicia y se construye normalmente sobre la base de una relación terapéutica o alianza de trabajo entre profesional e interno. Un elemento fundamental de la alianza terapéutica es la confianza entre profesional e interno, en la que juega un papel esencial la confidencialidad. Sin embargo, dadas las características de la población penitenciaria, a menudo el profesional del tratamiento puede verse enfrentado a situaciones en las que la relevancia penal de las informaciones vertidas por el interno le obligue a cuestionarse los límites de la confidencialidad. ¿Qué sucedería si un interno manifiesta durante una entrevista la comisión de un delito no conocido por el sistema de justicia penal? ¿O revela la existencia de una victima no identificada por la policía? ¿Debería el profesional dar parte a las autoridades competentes? La respuesta a estas preguntas no es sencilla. Por ello, se analiza en este artículo la importancia de la confidencialidad como requisito para establecer una relación terapéutica, el concepto, alcance y límites del secreto profesional, así como su regulación en algunas profesiones, centrándonos finalmente en su extensión y posibles limitaciones en el ámbito penitenciario.

    Currently, a purpose of reeducation and reinsertion is assigned to the Penitentiary Institutions. The instrument used to perform this purpose is the penitentiary treatment, which is initiated and built on the basis of a therapeutic relationship or working alliance between professional and inmate. Trust between officer and prisoner is a fundamental element of the therapeutic alliance, in which confidentiality plays an essential role. However, given the characteristics of the prison population, the treatment professional can often face situations in which the criminal relevance of the information provided by the inmate forces him to question the limits of confidentiality. What would happen if an inmate claims during an interview the commission of a crime unknown by the criminal justice system? Or he reveals the existence of a victim not identified by the police? Should the professional report it to the competent authorities? The answer to these questions is not simple. Therefore, this article analyzes the importance of confidentiality as a requirement to establish a therapeutic relationship, the concept, scope and limits of professional secrecy, as well as its regulation in some professions, focusing finally on its extension and possible limitations
