Este estudo comparado, sobre gestação de substituição,pretende fazer um breve comentário, relativamente ao impacto natural na legislação das novas possibilidades reprodutivas trazidas pelas actuais técnicas de Reprodução Medicamente Assistida, analisando comparativamente a Legislação de RMA Europeia sobre gestação de substituição, a qual actualmente se encontra suspensa no caso português, criando um impacto social e clinico que aos olhos de um jurista, nos dá indicação que (quer a comunidade médica quer a sociedade em geral), não estão actualmente preparadas, pretendendo dar uma nota positiva sobre a utilização desta técnica reproductiva apontando para a necessidade de homogenização da legislação internacional sobre este tema.

This comparative Study, about subrogated maternity wants to put out a brief commentary concerning the natural impact on Law of the new reproductive possibilities brought out from new Medically Assisted Reproduction technics, though the comparative of RMA European legislation on surro-gacy, which is nowadays suspended in the Portuguese case, creating social en medical impacts that in the eye of a jurist, will give indication they (society and medical community) are not actually prepared for, giving a positive insight to the use of this reproductive technique, pointing out the necessity of legislative homogenization of this theme in an internacional level.
